Our client, a glistening jewel in the crown of West Country law firms is seeking to appoint a well seasoned, professional and extremely knowledgeable Deputyship Lawyer.

Prime requirement is to meet the growing needs of the clinical negligence department.  With your vast experience and working knowledge, act as Deputyship and assist in expanding this service and department.

To act as Professional Deputy to clients whose financial affairs need to be overseen by the Court of Protection (CoP) following catastrophic personal injury/clinical negligence.  Also, to assist lay deputes in carrying out their duties acting on behalf of such clients.

To act for other classes of vulnerable clients and to provide Court of Protection Services, where the need for legal services does not arise from a compensation award.

Experience of the following is ideal – To apply for Property and Affairs Deputyship Orders.  Make applications to the Court of Protection and attend hearings at the Court.  Where personal injury or clinical litigation is ongoing, to liaise with the litigation lawyers in relation to budgeting, disclosure and file management.

Assume responsibility, for the management of the client relationship, to include the parents/carer of the protected person.  To implement the recommendations for care, accommodation, therapy, equipment and the financial management that are set out in the final settlement advice/judgement of the court.

To develop and maintain file management protocols to meet the needs of the litigation and deputyship files.  To supervise the work of the Deputyship Administrator.  To work closely with the family of the client to ensure that dealing with the Court of Protection is as smooth and efficient as possible.

Ensure that tax returns and Deputy’s accounts are prepared and files on time.  To prepare a specification or a property purchase, to identify and purchase a suitable property.  To work with the Property Department (which will provide conveyancing services) to ensure that the requirements of the court of Protection in relation to sales and purchases are met, and that the appropriate land and registry protections are in place.    Prepare Trust deeds relating to sale and purchase of property.  To instruct architects and with them to – obtain a feasibility/suitability report for adaptations, assess the availability of Local Authority grants to fund adaptations for a disabled client.   Co-ordinate planning ad building regulations applications.  Asses tenders for building works, review the terms of a building contract and agree the specification of works, the timescale for completion and the structure for phased payments.  Secure an insurance bond o cover the cost of the buildings works in the event that the building contractor goes into liquidation before completing the works.    Obtain final certificates and guarantees for the building works.

Liaise with the IFA’s and fund managers.  To instruct other professionals where appropriate – accountants, specialist lawyers to deal with special educational need or tribunals.  Liaison with other third parties such as case managers, therapists, medical practitioners etc.  Provide tax advice and arrange ongoing review of investment strategy.

Advise in relation to welfare benefits and state assistance.  Preparation of personal injury trusts, prepare lasting and ordinary powers of attorney, authorisation of gifts and prepare statutory wills.

We are seeking a lawyer who would expand our clients Deputyship service.  Market the Deputyship service and become involved in Court of protection network groups.   A lawyer, who has experience of acting a professional deputy, providing advice to Lay Deputies.

A professional, who has experience of supporting vulnerable clients.   Developing and maintaining file management procedures and finally experience of Trusts, Welfare Benefits, Personal Tax and Wills.
