We are seeking to locate a seasoned private client lawyer for our law firm client.  They can be described as medium sized, multi-office and progressive in terms of corporate-ethos. Our law firm client has an excellent reputation for client care and having the knowledge to set up and administer complex trust work. Ideally we are seeking to find an ambitious associate who is looking to move up to the rank of senior associate/manager in the near future. We would also invite applications of a senior associate – 15PQE+ who is looking to be considered for the succession programme. This does not guaranty a shot at partnership but you’re in the race as a contender.

Our client has an excellent reputation for setting up and running complex multi-product trusts for private clients. We would welcome applications from trust experts, whether you’re currently working at a law firm, investment bank or accountancy practice applications are invited on a nationwide basis, no matter what county you currently reside and practice business. Our client law firm has been established for many years in fact one of their family clients has been with the firm for three generations. Working for a firm such as our client, business referrals will flow. Client marketing will be expected and you will be asked about this factor on meeting. We would like candidates to have business generation facts and information available at the preliminary meeting. Local membership to golf, tennis clubs and other social-hubs will be encouraged. If you’re a lawyer and a keen golfer with an excellent progressive handicap, your membership fees to one prominent club will be paid for by our client.

Strategic tax planning

Our client’s lawyers have detailed knowledge of the appropriate structures for holding assets, whether through trusts, companies or partnerships. They offer and implement advice on wills and lifetime gifts or settlements and on minimising capital taxation. Lawyers have extensive experience of the complex tax reliefs available for heritage property, and of advising how to extract the maximum benefit from them.

Wills and Powers of Attorney

Wills are a very important part of planning to meet family circumstances and substantial tax savings can be achieved by a correctly drawn will. Powers of attorney are also crucial in providing for management of your affairs if you should encounter either sudden or long term health problems.

 Probate and Administration of estates

  • Income Tax Returns;
  • Some administration of Trusts and trust accounts;
  • Preparation of Enduring Power of Attorney, registration of Enduring of Attorney and Receivership Accounts;
  • Preparing and submitting forms FR1, AP1, TR1, AS1 and RX3;
  • Management, administration and distribution of estates;
  • Probate and letters of administration for large and small estates including all aspects from initial interview with client;
  • Preparation and drafting of all required special requirement documentation;
  • Valuation of assets;
  • Preparation of Inheritance tax forms; obtaining the grant and dealing with the closure and the final tax issues;
  • Distribution accounts;
  • Wills including will trusts and estate planning relating to inheritance tax or care home fees;
  • Preparation and drafting of wills and complex matters to do with wills;

Real Estate conveyancing knowledge is very useful to a private client lawyer especially in probate cases; although useful, not essential and definitely not a deal breaker.

  • Drafting or checking sales contracts and agreeing terms with the lawyer acting for the other party to the transaction;
  • Collating and sending or checking supporting documents;
  • Exchanging contracts and completing the transaction;
  • Dealing with all financial aspects of a transaction;
  • If the property is leasehold, obtaining the landlord’s agreement to the sale or the change of mortgage and dealing with apportionments of rent and service charges;
  • Specific tasks for sales transactions include preparing the seller’s property information form; repayment of charges and paying the estate agent’s fee;
  • Carrying out and checking pre-contract searches by checking whether the property is affected by local authority proposals, leases, easements or covenants, mortgages, land tax, susceptibility to flooding or subsidence, or liability for unsound building structures and repairs;
  • Receiving and checking mortgage instructions from lenders and undertaking specific tasks required;
  • Preparing transfer and mortgage deeds;
  • Receiving mortgage funds;
  • Paying stamp duty and land tax and dealing with the registration of client and lender with the land registry.
