Private Client Partner, South West Law firm. 100-350K+

We are currently recruiting a new Partner for an established law firm with a growing client base. Future succession is the reason for the external recruitment of this particular Partner position.

Our law firm client is looking for a Partner who is hard-working, dynamic and will be looking to add to thier business. Ideally you should have inexcess of ten years PQE and have thorough experience in the following Private Client work:

Wills and letters of wishes – Considering domicile issues, drafting wills incorporating nil rate band discretionary trusts (debt/charge provisions), highlighting any IHTA 1984 s.103 issues, advising on Immediate Post Death Interest Trusts, Bereaved Minor Trusts and age 18-25 trusts, and the transferable nil rate band provisions. Providing devolution advice for the complex family unit, providing for vulnerable and disabled beneficiaries and considering disabled trust options and how these might affect entitlement to welfare benefits. Tax planning for civil partners; preparing UK wills for international clients; advice on transferable nil rate bands, the inclusion of nil rate band discretionary trusts, tax planning with IPID’s and drafting letters of wishes.
Administration of estates – Both modest and multi-million including those for Lloyds names, patients of the Court of Protection, farmers and landowners and foreign domiciliaries; administering discretionary will trusts, variations and disclaimers (including intestacy with minor interests), estate tax planning for inheritance tax and Capital Gains Tax. Administration of insolvent estates, negotiation of valuations of various assets, preparation of estate accounts, forms 922 and R185(EI). Estate Duty calculations on previously conditionally exempted items.
Tax planning – Advice on routing alienable benefits of insurance and pension policies outside a person’s estate. Drafting suitable receptacle trusts and effecting assignments. Use of pilot trusts. Advising on double trust arrangements and past tax saving arrangements, the previously owned assets tax, gifts with reservation of benefit and settler interested provisions. Advice on Children Act 1984 Trusts, and for those divorcing. Advice for onshore and offshore international clients, wishing to immigrate or emigrate; on domicile, residence, the remittance basis and conflict of laws. Personal injury trusts, Deputyships, Receiverships and Court of Protection work – Overseeing Deputyship work; setting up of PI trusts.

Contentious Probate – Pre-litigation advice on contentious probate and trust issues; private client support on contested 1975 Act claim with preliminary domicile issues.

Creating departmental systems – Setting up precedents and private client library; developing file management systems (engagement letters, file reviews, file closing, deeds storage); conducting monthly work in progress and know how meetings.

Team building – Recruiting solicitors, FILEX, paralegal and secretaries; mentoring trainees; expanding depth and breadth of fee earners’ knowledge and skills.

Risk management – Reviewing firm’s trusts, identifying Finance Act 2006 and construction issues; updating trusteeship. Ensuring client care and money laundering compliance. Revising department’s clients’ terms of business on firm’s incorporation to LLP.
